المستخلص Atomic waste and its danger to society ”a comparative study in Islamic law and international law” This study examines the danger of atomic waste in general, especially radioactive ones, to the environment, humans, animals and even the land in which we are buried. This research is a comparative analytical method. Analytical because the narration of these texts requires us to analyze and scrutinize them in a way that makes us discern their sufficiency and their shortcomings. God forbid that there should be shortcomings in the approach of Islamic Sharia, and comparative because the treatment of the subject is at the level of Islamic and positive legislation represented in general international law and the rules contained in both, which came specifically to protect the environment of all the dangers that surround it. I have no doubt that this topic is one of the important topics that are directly related to the topic of pollution, which has become the talk of the world. This study is oriented chronologically in the period beginning with the year (1945 AD), which is the period in which the treaties on the non-proliferation of nuclear weapons began until the preparation of this study, and in line with the chosen method and until we negate the sound scientific method. Islamic organizations from the spread of atomic waste and international conventions and treaties. As for the first chapter, I devoted it to talking about the definition of atomic waste, and I also made the second chapter to discuss the impact of atomic waste on health and the environment. The third chapter was devoted to talking about the transfer of atomic waste. As for the last chapter, I set it up to talk about penalties in Islamic law and international law for the reduction of atomic waste, then the conclusion of the research and recommendations. We recall from what it stated that Islamic organizations must address the issue of the environment and not harm it, especially the damage caused by atomic (radioactive) waste. By researching, studying, and issuing jurisprudential fatwas that forbid that, also the importance of spreading environmental awareness among people. Also, the urgent need to establish a permanent court for the protection of the environment from atomic waste, to be attached to the International Court of Justice and the International Criminal Court. Finally, we say that if this study is a study in Islamic law and international law, it is only a preliminary study of this important topic, which foretells studies that can be conducted in this field, whether from the legal, legal, scientific, administrative, criminal or international level, whether on a personal or at the state level. |
